Feradel, LLC (“Feradel,” “we,” “us,” or “our”) respects your privacy and is committed to protecting the personal information entrusted to us. This Privacy Policy explains how we collect, use, disclose, store, and protect information when you visit https://www.feradel.com, create a Feradel account, use a Feradel application, access a Feradel application programming interface (“API”), communicate with us, or otherwise use any website, software platform, mobile interface, integration, product, or service operated by Feradel (collectively, the “Services”).
By accessing or using the Services, you acknowledge that you have read and understood this Privacy Policy. Your use of the Services is also subject to Feradel’s applicable Terms of Use, subscription terms, product-specific terms, and any written agreement between Feradel and you or the organization on whose behalf you use the Services.
Who we are
Feradel, LLC is a software services company that provides cloud-based software, platform services, APIs, integrations, communications tools, document-processing tools, workflow systems, and related products. Our website address is https://www.feradel.com.
Feradel products may include, without limitation, FeraMatters, FeraCal, FeraChat, FeraEmail, FeraSign, FeraRender, FeraSurvey, FeraFiles, FeraLink, licensing and authentication services, and other products or services that Feradel may introduce, rename, combine, or discontinue.
Scope of this Privacy Policy
This Privacy Policy applies to information collected by Feradel through the Services. It does not apply to information collected independently by third parties, even when a third-party service is accessible through or integrated with the Services. Third-party websites, applications, payment processors, identity providers, communications platforms, and integrations are governed by their own privacy policies.
Some Feradel customers use the Services to collect, store, transmit, organize, sign, render, analyze, or otherwise process information concerning their own clients, customers, employees, users, or other persons. In those circumstances, the Feradel customer generally determines the purpose and means of processing that information, and Feradel processes the information on the customer’s behalf. Questions about information submitted to the Services by a Feradel customer should ordinarily be directed first to that customer.
Information we collect
The information we collect depends on how you interact with Feradel, which Services you use, and the choices made by you or your organization.
Information you provide directly
We may collect information that you provide directly to us, including:
- Your first and last name;
- Business or organization name;
- Job title or professional role;
- Email address;
- Telephone number;
- Mailing or billing address;
- Username, password, authentication credentials, and account-recovery information;
- Subscription, licensing, billing, and transaction information;
- Communications with Feradel, including support requests, feedback, survey responses, and sales inquiries;
- Information entered into forms, questionnaires, calendars, matters, workflows, templates, files, messages, signature requests, or other Service features;
- Documents, images, recordings, attachments, and other materials uploaded to or generated through the Services;
- Integration settings, API configuration information, webhook destinations, and authentication tokens;
- Information submitted when you participate in a promotion, beta test, webinar, demonstration, or event; and
- Any other information you voluntarily provide.
Customer content
“Customer Content” means information, data, text, files, documents, images, messages, calendar entries, contacts, signatures, templates, prompts, outputs, and other materials submitted to, transmitted through, stored in, or generated by the Services at the direction of a customer or user.
Customer Content may contain personal information or confidential information concerning persons other than the account holder. Customers and users are responsible for determining that they have the legal right, authority, consent, and lawful basis necessary to submit and process Customer Content through the Services.
Information collected automatically
When you access or use the Services, Feradel and its service providers may automatically collect technical and usage information, including:
- Internet Protocol address;
- Browser type and version;
- Device type, operating system, and device identifiers;
- Approximate geographic location derived from an IP address;
- Referring and exit pages;
- Dates, times, duration, and frequency of access;
- Pages, screens, features, buttons, links, and functions accessed;
- API calls, response codes, usage volumes, resource consumption, and rate-limit information;
- Login, authentication, security, and audit events;
- Error reports, diagnostic information, and performance data;
- Cookie identifiers and similar technologies; and
- Information concerning how the Services are configured and used.
Information received from other sources
We may receive information from third parties, including an organization that creates or administers your account, authorized users within your organization, payment processors, authentication providers, integration partners, referral sources, analytics providers, publicly available sources, and other services that you direct to exchange information with Feradel.
How we use information
Feradel may use information for the following purposes:
- To provide, operate, maintain, host, and support the Services;
- To create, authenticate, administer, and secure user accounts;
- To process subscription requests, licenses, usage allocations, renewals, upgrades, and transactions;
- To provide requested functionality, including communications, scheduling, document rendering, file storage, electronic signatures, surveys, workflow automation, and integrations;
- To respond to questions, support requests, complaints, and other communications;
- To communicate about accounts, transactions, security events, product changes, maintenance, and service notices;
- To personalize and improve the Services;
- To measure usage, performance, reliability, and customer engagement;
- To troubleshoot technical issues and prevent service interruptions;
- To detect, investigate, prevent, and respond to fraud, abuse, unauthorized access, malicious activity, and security threats;
- To enforce our agreements, usage limits, subscription terms, and acceptable-use requirements;
- To develop, test, maintain, and improve products, features, models, systems, and internal processes;
- To comply with legal, regulatory, tax, accounting, court, and law-enforcement obligations;
- To establish, exercise, or defend legal claims;
- To protect the rights, safety, property, and security of Feradel, our customers, users, and others;
- To send marketing or promotional communications where permitted by law;
- To conduct business planning, reporting, auditing, and corporate transactions; and
- For other purposes disclosed at the time information is collected or with your authorization.
Artificial intelligence and automated features
Certain Services may include artificial intelligence, machine-assisted drafting, automated classification, recommendation, extraction, summarization, rendering, or similar functionality. When you use these features, information submitted to the feature may be processed to generate the requested output, administer the feature, detect misuse, maintain security, troubleshoot errors, and evaluate performance.
Unless otherwise stated in a written agreement or product-specific disclosure, Feradel does not use Customer Content submitted through paid business accounts to train a publicly available general-purpose artificial-intelligence model. Feradel may use de-identified, aggregated, statistical, diagnostic, or usage information to maintain and improve the Services, provided that such information does not reasonably identify an individual or customer.
AI-generated and automated outputs may be incomplete or inaccurate. Users are responsible for reviewing outputs before relying upon, transmitting, filing, publishing, or otherwise using them.
Cookies and similar technologies
Feradel and its service providers may use cookies, local storage, pixels, session identifiers, and similar technologies to operate the Services, maintain sessions, remember preferences, authenticate users, measure performance, understand usage, protect accounts, and improve functionality.
If you visit a login page, we may set a temporary cookie to determine whether your browser accepts cookies. When you log in, cookies or similar technologies may be used to maintain your authenticated session, save preferences, and support account security. Selecting a “Remember Me” or similar option may extend the duration of the login session.
You may configure your browser to refuse or delete cookies. Disabling cookies may prevent some portions of the Services from functioning properly.
Comments, reviews, and public submissions
If visitors are permitted to leave comments, reviews, ratings, or other public submissions, we may collect the information entered into the applicable form, together with the visitor’s IP address, browser information, and related metadata for moderation, security, and spam-detection purposes.
Information submitted to a public area of the Services may be visible to others. Do not submit confidential, privileged, proprietary, or sensitive information to a public field.
An anonymized string generated from an email address may be provided to a profile-image service, such as Gravatar, to determine whether the user has an associated profile image. Third-party profile-image services are governed by their own privacy policies.
Media and uploaded files
If you upload images, documents, or other files, those files may contain metadata, embedded location data, author information, revision history, comments, hidden text, or other information. You should remove information that you do not intend to disclose before uploading a file.
Persons who are authorized to access an uploaded file may be able to download the file and inspect information embedded within it.
Payment information
Payments may be processed by a third-party payment processor. Feradel may receive limited transaction information, such as the payer’s name, billing address, payment status, transaction identifier, subscription level, and the last digits or expiration information associated with a payment method. Feradel does not necessarily receive or store complete payment-card numbers.
The processing of payment information by a payment processor is governed by that processor’s privacy policy and terms.
Embedded content and third-party integrations
The Services may contain embedded content or integrations involving third-party websites, applications, videos, images, communications platforms, calendars, payment systems, identity providers, storage systems, or other services. Embedded content may behave as though you visited the third-party service directly.
Third parties may collect information, use cookies, perform tracking, or monitor your interaction with their content or services. When you connect a third-party integration, you authorize Feradel to exchange information with that service as necessary to provide the requested integration.
Feradel is not responsible for the privacy, security, availability, or data practices of an independent third party.
How we disclose information
Feradel does not sell personal information for monetary compensation. We may disclose information in the following circumstances:
- At your direction. We may disclose information when you request, authorize, or direct us to do so.
- Within your organization. Account owners, administrators, managers, or other authorized users may be able to access information associated with an organizational account.
- Service providers. We may disclose information to vendors that provide hosting, infrastructure, security, authentication, communications, analytics, payment processing, customer support, document processing, storage, monitoring, and related services.
- Integrations. We may exchange information with third-party services that you or your organization connect to the Services.
- Professional advisers. We may disclose information to attorneys, accountants, auditors, insurers, and other professional advisers when reasonably necessary.
- Legal compliance. We may disclose information in response to a subpoena, court order, warrant, legal process, regulatory request, or other lawful demand.
- Protection and enforcement. We may disclose information when reasonably necessary to investigate fraud, enforce agreements, protect security, prevent harm, or protect the rights and property of Feradel, our users, customers, or others.
- Corporate transactions. Information may be disclosed or transferred in connection with a merger, financing, acquisition, reorganization, bankruptcy, sale of assets, or similar transaction.
- Aggregated or de-identified information. We may disclose information that has been aggregated or de-identified so that it does not reasonably identify an individual or customer.
Account administration
When an account is created or administered by an employer, law firm, business, organization, or other customer, that organization may control the account and associated Customer Content. Its authorized administrators may be able to:
- Add, suspend, restrict, or remove users;
- Assign permissions, roles, licenses, and product access;
- Access account activity, audit information, and Customer Content;
- Configure retention, integrations, authentication, and security settings;
- Export, transfer, or delete information; and
- Otherwise administer the organization’s use of the Services.
Users of an organization-controlled account should direct questions about organizational access and administration to the applicable organization.
Data security
Feradel uses administrative, technical, and physical safeguards designed to protect information against unauthorized access, disclosure, alteration, destruction, or misuse. These safeguards may include access controls, authentication systems, encryption, logging, monitoring, backups, network protections, and security-review procedures.
No method of electronic transmission, processing, or storage is completely secure. Feradel therefore cannot guarantee that information will never be accessed, disclosed, altered, lost, or destroyed without authorization.
You are responsible for safeguarding your credentials, maintaining appropriate access controls, using secure devices and networks, promptly removing former users, and notifying Feradel of suspected unauthorized access.
Data retention
We retain information for as long as reasonably necessary to provide the Services, maintain accounts, complete transactions, comply with legal and contractual obligations, resolve disputes, enforce agreements, prevent fraud, maintain security, and support legitimate business operations.
Retention periods may vary depending on the type of information, the Service involved, customer configuration, contractual requirements, backup schedules, legal obligations, and whether an account remains active.
Customer Content may remain temporarily in backups, archives, logs, disaster-recovery systems, or records that Feradel is legally required or reasonably permitted to retain. Information may also be retained in de-identified or aggregated form.
If comments or public submissions are enabled, the submission and associated metadata may be retained to support moderation, security, and recognition of follow-up submissions.
Your choices and privacy rights
Depending on your location and applicable law, you may have the right to request:
- Confirmation of whether Feradel processes your personal information;
- Access to personal information maintained about you;
- Correction of inaccurate personal information;
- Deletion of certain personal information;
- A portable copy of certain personal information;
- Restriction of or objection to certain processing;
- Withdrawal of consent where processing is based on consent; and
- Review of certain automated decisions where required by law.
These rights are subject to legal limitations and exceptions. For example, Feradel may retain information needed for security, fraud prevention, legal compliance, recordkeeping, contract administration, dispute resolution, or the establishment, exercise, or defense of legal claims.
If Feradel processes information on behalf of a business customer, we may direct your request to that customer or ask you to submit the request directly to it.
Feradel may take reasonable steps to verify your identity and authority before fulfilling a request. An authorized agent may submit a request where permitted by law, but Feradel may require evidence of the agent’s authority and verification of the individual’s identity.
Marketing communications
You may opt out of promotional emails by using the unsubscribe mechanism included in the message or by contacting Feradel. Even after opting out of marketing communications, you may continue to receive transactional, administrative, security, billing, support, and account-related communications.
Do Not Track and browser signals
Some browsers transmit “Do Not Track” or similar signals. Because no uniform standard presently governs all such signals, the Services may not respond to every browser-based signal. Where applicable law requires recognition of a particular privacy-preference signal, Feradel will process the signal as required by law.
International processing
Feradel is based in the United States. Information may be processed or stored in the United States or in other countries where Feradel or its service providers operate. Those countries may have privacy laws that differ from the laws of your jurisdiction.
Where required, Feradel may use contractual, organizational, or other lawful mechanisms intended to protect information transferred across national borders.
Children’s privacy
The Services are intended for businesses and adults and are not directed to children under thirteen years of age. A minor may not independently create or administer a Feradel account unless permitted by applicable law and expressly authorized by a parent, legal guardian, educational institution, business customer, or other responsible organization.
Customer Content may include information about minors when a customer has a lawful reason and appropriate authority to process that information. In those circumstances, the customer is responsible for determining the lawful basis for collection and use.
If you believe a child has provided personal information directly to Feradel without appropriate authorization, contact us so that we may evaluate the request and take appropriate action.
Sensitive and regulated information
Unless a written agreement or product description expressly provides otherwise, the Services are not designed to receive or process classified information, payment-card data outside designated payment fields, protected health information subject to HIPAA, consumer-report information subject to the Fair Credit Reporting Act, or other specially regulated information.
Customers must not submit specially regulated information unless they have confirmed that the applicable Service and written agreement expressly authorize that use and include any legally required terms.
Legal process and customer notice
Feradel may review and respond to subpoenas, court orders, warrants, and other legal demands. Where legally permitted and reasonably practicable, Feradel may provide notice to the affected customer before disclosing Customer Content so that the customer may seek appropriate protection. Feradel may be prohibited from providing notice in certain circumstances.
Business transfers
If Feradel is involved in a merger, acquisition, financing, reorganization, bankruptcy, receivership, sale of assets, or transition of services to another provider, information may be transferred as part of that transaction, subject to applicable law and appropriate confidentiality protections.
Changes to this Privacy Policy
Feradel may update this Privacy Policy from time to time. The revised policy will be posted through the Services with an updated effective date. When legally required or when changes are material, Feradel may provide additional notice through the Services, by email, or by another appropriate method.
Your continued use of the Services after the effective date of a revised Privacy Policy constitutes acknowledgment of the revised policy, except where applicable law requires a different form of consent.
